Terms of Use

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, disassemble, or create derivative works of the App
• Remove, alter, or obscure any proprietary notices from the App
• Use the App for any illegal, harmful, or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App or its systems
• Use automated scripts, bots, or similar tools to access the App
• Interfere with or disrupt the App's functionality or servers
• Reproduce, distribute, publicly display, or create derivative works from the App
• Sell, rent, lease, sublicense, or transfer your rights to use the App
• Use the App to harm minors in any way
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Upload or transmit viruses, malware, or other malicious code
• Violate any applicable laws, regulations, or third-party rights

5.1 Account creation

The App uses RevenueCat to manage user accounts and subscriptions. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5.2 User data

You retain all rights to any content you create within the App. By using the App, you grant us a license to use, store, and process your data as described in our Privacy Policy. We will handle your data in accordance with applicable privacy laws.

5.3 Accuracy of information

You agree to provide accurate, current, and complete information during the onboarding process and to update such information to maintain its accuracy.

6.1 Access model

The App requires a paid subscription to access full features. We offer the following auto-renewing subscription options:

• "Bropush Weekly"
• "Bropush Yearly"

We offer a 3-day free trial period so you can experience the App before committing to a paid subscription. Current prices for all subscription options are clearly displayed in the App prior to purchase.

6.2 Trial period

• All new users receive a 3-day free trial to test all features
• After the trial period ends, you will be charged for your subscription unless you cancel before the trial expires
• You can cancel the trial at any time through your App Store or Play Store account settings
• We reserve the right to modify or discontinue trial offers at any time

6.3 Payment processing

• Payment is processed through Apple's App Store or Google Play Store
• Payment will be charged to your Apple App Store or Google Play Store account upon confirmation
• Subscriptions automatically renew on a recurring basis unless you cancel at least 24 hours before the renewal date
• You can manage or cancel your subscription through your App Store or Play Store account settings at any time

6.4 Pricing changes

We reserve the right to change subscription pricing at any time. For existing subscribers, we will provide at least 30 days' notice before any price increase takes effect. Price changes will not apply to your current subscription period if you purchased before the change.

7.1 Ownership

The App, including all content, features, functionality, software, design, text, graphics, logos, and underlying technology, is owned by the Developer and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Training methodology

The Grease the Groove (GTG) training methodology used in the App is based on established fitness practices. All training plans, rep calculations, and guidance are proprietary to Bropush and protected by intellectual property law.

7.3 User training data

You retain ownership of your personal training data (records, progress, performance metrics). By using the App, you grant us a license to store, process, and analyze your training data to provide personalized training plans and progress tracking, as described in our Privacy Policy.

7.4 Trademarks

"Bropush" and associated logos are trademarks of the Developer. You may not use these trademarks without prior written permission.

8.1 Not medical or professional fitness advice

THE APP IS NOT INTENDED TO PROVIDE MEDICAL, PHYSICAL THERAPY, OR PROFESSIONAL FITNESS TRAINING ADVICE. The training programs and content provided are for informational and educational purposes only and should not be considered a substitute for professional medical, fitness, or physical therapy advice, diagnosis, or treatment.

8.2 Consult professionals

Always consult with qualified healthcare providers or certified fitness professionals before starting any new training program, especially if you have pre-existing health conditions, injuries, or physical limitations. Never disregard professional medical advice or delay seeking it because of content in this App.

8.3 Emergency situations

If you are experiencing a fitness injury, health emergency, or mental health crisis, immediately contact emergency services:

• Poland: 999 (Medical Emergency) or 112 (European Emergency Number)
• Poland Mental Health Support: 116 123 (Emotional Support Line - available 24/7)
• European Emergency: 112 (Available in all EU countries)
• United States: 911 or 988 (Suicide & Crisis Lifeline)

The App is not designed for crisis intervention or emergency mental health support.

10.1 EU consumer notice

For EU Consumers: Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded or limited under applicable consumer protection laws
• Breach of the mandatory conformity requirements under EU law

10.2 Exclusion of damages (Non-EU users or as permitted by law)

Subject to Section 10.1, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

• Loss of profits, revenue, or data
• Loss of goodwill or reputation
• Business interruption
• Personal injury or emotional distress (except where caused by our negligence)
• Any other intangible losses

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.3 Maximum liability (Subject to mandatory consumer laws)

Subject to Section 10.1, our total liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the greater of:

(a) The amount you paid to us in the twelve (12) months preceding the claim, or
(b) One hundred euros (€100.00)

10.4 Essential purpose

You acknowledge that these limitations of liability are an essential element of the agreement between you and us, and that we would not provide the App without these limitations, except where such limitations are prohibited by mandatory consumer protection laws.

12.1 Changes to the app

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12.2 Changes to terms

We may revise these Terms from time to time. The "Last Updated" date at the top of these Terms indicates when they were last revised. Material changes will be notified through the App or via email (if provided). Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

13.1 Termination by you

You may stop using the App and delete it from your devices at any time. Deleting the App does not automatically cancel paid subscriptions—you must cancel through your App Store or Play Store account.

13.2 Termination by us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

13.3 Effect of termination

Upon termination:

• All licenses granted to you will immediately terminate
• You must cease all use of the App and delete it from your devices
• Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability

17.1 App Store terms

If you access the App via Apple's App Store, you acknowledge that:

• These Terms are between you and the Developer, not Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them

17.2 Google Play terms

If you access the App via Google Play, you agree to Google Play's Terms of Service, which can be found at https://play.google.com/intl/en_us/about/play-terms/
